The Louisiana Choose Life license plate
won another round in court on Friday, August 9, 2002, when the 5th Circuit
Court of Appeals refused to grant an "en banque" hearing which
would have given the plaintiffs a hearing before all on the circuit.
In March, 2002, the 5th Circuit Court of
Appeals ruled that the plaintiffs did not have a standing to challenge the
license plate. They ordered the Federal District Judge, Stanwood
Duval, to lift his injunction on the sale of the plates. The Center
for Reproductive Law and Policy, the New York law firm which is suing the
state over the plate, immediately asked for a full hearing before the 5th
Circuit. Friday's ruling dashed all hope of that. According to
Bill Rittenberg, a local attorney involved in suing the state, the
plaintiffs might try to get the Supreme Court to hear the case and they
will probably ask Judge Duval to keep the injunction intact until that
happens. "We're going to continue to do everything to keep them
from becoming available," Rittenberg said.
Local pro-life attorney, Dorinda Bordlee,
expects that the plates will be on the road within a few months.
